Condominium Act Changes

Ontario’s new Condominium Act was proclaimed on May 5, 2001.

In keeping with the new legislation, there are three new instrument types offered by our e-reg™ software:

1. Condominiun Lien (Condominium Act 1998)

2. Condominium ByLaw (Condominium Act 1998)

3. Discharge of Common Elements Condominium Interest

 

Please ensure that you choose the correct instrument type for your transaction, consistent with the new Condominium Act.

Please be advised that along with the new instrument types, the system also provides new error messages to alert you when something is wrong.

The new messages will occur in the following situations:

Situation One

The system checks on signing that the document type entered in Statement 4035 (This discharge discharges the interest in INSTRUMENT NUMBER) is acceptable.

If it is found unacceptable, an error message will state: “You have lost your Teraview® connection (error 15927) please log back into the application & try again. If the problem persists, contact customer service immediately.”

TRANSLATION: The suggested instrument is not of an instrument type acceptable as a source for this statement.

Situation Two

Upon registration, the system validates that the “Party From” in the discharge document matches the “Party To” on the instrument quoted in Statement 4035 (This discharge discharges the interest in INSTRUMENT NUMBER). If they do not match, you will receive an error message advising that the “Party From” does not match the “Party To” on the source instrument.

Situation Three

If the particular instrument you are referencing is not found in POLARIS®, you will receive an error message that states: “You have lost your Teraview connection (error 15928) please log back into the application & try again. If the problem persists, contact customer service immediately.

TRANSLATION: The suggested source instrument for statement 4035 (This discharge discharges the interest in INSTRUMENT NUMBER) is not in POLARIS.

It is not necessary to contact Customer Service for the above errors, only to ensure correct data is entered.

The error messages will be clarified in the next release of the e-reg® software, Teraview 5.0, scheduled to be out this summer.
